1. Overview
These Terms of Service ("Terms") govern your use of the PostCare platform operated by OptimyCloud LLC. By creating an account, you agree to these Terms.
2. Description of Service
PostCare is a SaaS platform that enables beauty, aesthetics, dental, and healthcare professionals to send automated aftercare messages to their clients via WhatsApp. The service includes client management, AI-powered protocol analysis, message scheduling, concern tracking, and recovery photo documentation.
3. Account & Responsibilities
You must provide accurate information when creating your account. You are responsible for maintaining the confidentiality of your login credentials.
As a clinic professional, you are responsible for obtaining proper consent from your clients before enrolling them in aftercare messaging sequences.
4. Data & Privacy
You retain ownership of all client data uploaded to PostCare. We process this data solely to provide the service. See our Privacy Policy for details on data handling.
5. Pricing & Payment
PostCare offers subscription plans. Pricing details are available on the platform. Subscriptions are billed monthly or annually. Refunds are handled on a case-by-case basis.
6. Availability & Support
We aim for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance. Support is available via email at contact@postcare.net.
7. Limitation of Liability
PostCare is a messaging tool and does not provide medical advice. Clinic professionals remain fully responsible for the medical accuracy of aftercare instructions sent through the platform. OptimyCloud LLC shall not be liable for indirect, incidental, or consequential damages.
8. Termination
Either party may terminate the service at any time. Upon termination, your data will be retained for 30 days before permanent deletion. You may request a data export before termination.
9. Modifications
We may update these Terms from time to time. Users will be notified of material changes via email. Continued use after changes constitutes acceptance.
10. WhatsApp Business Compliance
PostCare delivers aftercare messages through Twilio's WhatsApp Business API. By using PostCare, you agree to comply with Meta's WhatsApp Business Policy and Commerce Policy. You must obtain explicit consent from clients before enrolling them in messaging sequences. Clients can opt out at any time by replying STOP. You are solely responsible for the content of messages sent through the platform. PostCare reserves the right to suspend accounts that violate WhatsApp's policies.
11. Governing Law
These Terms are governed by the laws applicable in the jurisdiction of OptimyCloud LLC's incorporation. For users located in the European Union, mandatory consumer protection laws of your country of residence shall apply where they provide a higher level of protection. Any disputes shall first be resolved amicably. Where legal proceedings are necessary, they shall be subject to the competent courts, with EU residents retaining the right to bring proceedings in their country of residence as guaranteed by EU law.
12. Medical Disclaimer
PostCare is an aftercare communication tool. It is NOT a telemedicine platform, medical advisory service, or health information provider. PostCare does not provide medical diagnosis, prescribe treatments, or replace professional medical consultation.
All aftercare instructions sent through PostCare are defined exclusively by the clinic's healthcare practitioners. PostCare's AI assistant provides general aftercare reminders only and always redirects clients to contact their clinic or specialist directly for any medical concern.
For urgent symptoms or medical emergencies, clients must contact their healthcare provider or emergency services directly. PostCare is not liable for any medical decisions made based on messages sent through the platform.
